Application
- These general terms and conditions of rental are applicable to reservations and agreements relating to Casa Haiti Benissa, Carrer El Bellveure 16, 03710 Calpe, Alicante, Spain.
- In these general rental conditions, the term 'tenant' means: the person who enters into the rental agreement relating to the rental of the holiday home.
- Agreements deviating from these general conditions are only valid if agreed upon in writing.
Article 1 - Reservations
1. We will only accept reservations from persons aged 30 years or older. Reservations made by persons younger than that age are not valid. We reserve the right to refuse a reservation at any time without giving reasons.
2. After you have made a reservation, you will receive a confirmation, the general terms and conditions of hire and an invoice from us within five days. Payment of the invoice is subject to the conditions described under article 2.
3. We request that you check these documents for accuracy and inform us immediately of any inaccuracies. If you have not received an acknowledgement of receipt from us within 10 days of making the reservation, we request that you contact us immediately.
Article 2 - Payment
1) The following conditions apply to payment:
a) Payments only by bank transfer;
b) The invoice amount consisting of 30% of the total rental price, the deposit and cleaning costs must be paid within 7 days after the invoice date.
The remaining 70% of the total invoice amount must be paid no later than 12 weeks before the arrival date. You will receive a separate invoice for this.
c) If the reservation is made within one month before the arrival date, you must pay 100% of the invoice amount as well as the deposit and cleaning fee upon receipt of the invoice.
2) Payment must be made by transfer to the bank account number stated on the invoice sent to you.
By paying a (partial) payment of the entire rent, you confirm that you have read and agree to the general rental conditions. The rental ends by operation of law after the expiry of the agreed period.
In the event of late payment, as described under a of this article, you will be in default immediately after expiry of the payment term. In that case we reserve the right to cancel the reservation and dissolve the agreement.
Article 3 - Deposit
1. The tenant will be charged a deposit of € 750.00, which is intended to guarantee damage and/or costs in the broadest sense of the word that we may withhold in the event of non-compliance with the obligations of the tenant as a good tenant and those accompanying the tenant.
2. The deposit should, as already described in article 2 under II and III, be paid together with the (first) payment of the invoice.
3. In case the deposit is not paid, we are entitled to deny the tenant access to the holiday home. If you fail to pay the deposit, we shall also be entitled to dissolve the agreement with immediate effect.
4. The deposit or the remainder thereof, if any, shall be refunded within 14 days after departure, after settlement of any claims (e.g. damage to inventory/the holiday home and/or other costs), to an account to be specified by the Hirer and after this has been passed on to the Lessor. Any (further) claims for damages will not be cancelled by us through this refund.
5. If, in the event of damage (if any), it appears that the deposit is not sufficient to cover the full amount of the damage, we reserve the right to hold the Hirer liable for the (remaining) damage.
Article 4 - Changes
1. If the tenant, after the conclusion of the booking/agreement, wishes to make changes to the booking, we are not obliged to comply with this. It is at our discretion whether and to what extent changes are accepted. In principle, changes within 4 weeks before arrival are not allowed.
2. If, after the booking has been made, the tenant wishes to change to a different or non-consecutive/consecutive period of stay, the cancellation conditions laid down in Article 5 will apply.
Article 5 - Cancellation
Cancellation by the tenant must always be made in writing (by post or e-mail).
The following conditions apply:
- Partial payments will not be refunded in the event of cancellation.
- In the event of cancellation up to 7 weeks before the date of arrival, 50% of the rent will be due.
- In the event of cancellation up to 28 days prior to the date of arrival, 75% of the rent will be due.
- In the event of cancellation between seven days and the day of arrival, 100% of the rent will be due.
- In case you have not arrived within 24 hours after the agreed date without further notice, this will be considered as a cancellation and 100% of the rent will be due.
- In the event of cancellation by us, any monies already paid will be refunded in full.
Article 6 - Force majeure
1. Force majeure on our part exists if the execution of the agreement is fully or partly, temporarily or otherwise, prevented by circumstances beyond our control, including war risk, personnel strikes, blockades, fire, floods and other disturbances or events.
Article 7 - Liability/complaints/damage
1. The tenant and other users are fully and severally liable for all damage caused to the house, the inventory and all items belonging to the rented object during the rental period in question, unless the tenant and other users can make a plausible case that the damage cannot be attributed to them. We therefore advise you to inspect the inventory carefully upon arrival at the holiday home. If you discover any damage or defects, please report this to us immediately. (within 24hrs)
2. We accept no liability for theft, loss or damage of or to goods or persons, of any nature whatsoever, during or as a result of the stay in the holiday home.
3. We do not accept liability for construction activities on the (main) roads etc. in the vicinity of the holiday home. We do not accept liability for the failure or malfunction of technical equipment, utilities, the non-functioning or partial non-functioning of the internet and/or the TV.
4. The costs of normal maintenance and repair of defects are for our account. If any defects occur, the tenant must inform us immediately and follow our instructions as closely as possible.
5. Complaints should be reported immediately (within 24 hours) by email.
